Biteable Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of Biteable’s services (“Services”). Biteable refers to Biteable LLC in these Terms. By using our Services, you agree to these Terms. If you don’t agree, please don’t use our Services.

2. Services and Subscriptions

2.1. We offer free and paid subscription services. Details of our subscription plans are available at biteable.com/pricing.

2.2. Subscriptions automatically renew unless canceled before the renewal date.

3. User Content and Rights

3.1. Your Content: You retain ownership of the content you create using our Services.

3.2. Usage Rights: You have full rights to use, share, distribute, or monetize the videos you create using Biteable’s Services without restriction. This includes commercial use, sharing on social media, and incorporating into other projects.

3.3. Our License: By using our Services, you grant Biteable a limited license to:

  • Store and process your content solely for providing and improving the Services.
  • Perform analytics on usage patterns to enhance our product.
We want to be clear:
  • We do not use your content for marketing purposes or share it with other users or third parties unless you explicitly choose to do so.
  • Your content remains private and accessible only to you and those you choose to share it with, unless required by law.

You retain all ownership rights to your content. The license you grant us is limited to the purposes stated above and is necessary for us to provide and improve our Services.

4. Prohibited Uses

You may not use our Services for illegal activities, to infringe on others’ rights, or to violate these Terms. Specific prohibited uses include, but are not limited to:

  • Posting inappropriate, defamatory, or unlawful content
  • Violating intellectual property rights
  • Attempting to gain unauthorized access to our systems
  • Using the Services to distribute malware or conduct malicious activities

5. Account Security

You are responsible for maintaining the security of your account and password. Notify us immediately of any unauthorized use of your account.

6. Payment and Refunds

6.1. Subscription Fees: Fees for paid subscriptions are charged in advance according to your chosen plan (monthly or annual).

6.2. Cancellation and Refunds: YOU MAY CANCEL YOUR SUBSCRIPTION AT ANY TIME. HOWEVER, BITEABLE DOES NOT OFFER REFUNDS FOR ANY PRE-PAID FEES, INCLUDING FEES FOR NEW PURCHASES OR RENEWALS.

6.3. To avoid charges for a subsequent term, you must cancel before your renewal date.

7. Termination

We may terminate or suspend your account for violations of these Terms. Upon termination, your right to use the Services will cease immediately.

8. Intellectual Property

8.1. Biteable retains all rights to the Services and our content, except for your user-created content.

8.2. Stock Materials: We provide certain content, including but not limited to images, text, graphics, illustrations, logos, audio, video, and music (“Stock Materials”) through the Services. Biteable grants you a non-exclusive, non-transferable license to use Stock Materials as part of your created content, subject to the following conditions:

  • You may use Stock Materials for both personal and commercial purposes within videos created using our Services.
  • You may not use Stock Materials outside of videos created with Biteable’s Services.
  • You may not redistribute, sell, or license Stock Materials separately from your Biteable-created videos.
  • You must comply with any additional usage restrictions specified for particular Stock Materials within the Services.

8.3. You shall not modify or delete any copyright, trademark, or other proprietary notices that appear in the Stock Materials or the Services.

9. Disclaimer and Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. BITEABLE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

10. Privacy and Data Use

We respect your privacy. Our use of your personal information is governed by our Privacy Policy, available at https://biteable.com/privacy-policy/.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Delaware for the resolution of any dispute relating to these Terms or your use of the Services.
